Terms of Service

1. Scope

These terms of service apply to the use of the Questee platform (hereinafter "service"), operated by Dominik Schwarz Ventures GmbH.

2. Description of services

Questee is a SaaS platform for creating and evaluating interactive forms. The scope of functionality depends on the selected plan (Free or Pro).

3. Registration and account

Registration is required for use. You are responsible for the security of your account. Please inform us immediately of any unauthorised access.

4. Free plan

• Up to 5 forms
• Up to 100 responses per month
• AI features via credits (one-time purchase)
• Questee branding on forms

5. Pro plan

• Unlimited forms and responses
• AI features included (fair use: 200 calls/month)
• No branding on forms
• Custom domain (optional)

Payment is monthly via Stripe. You can cancel at any time effective at the end of the billing period.

6. Credits

Credits are a virtual currency for using premium features on the Free plan. Purchased credits do not expire. Refunds are excluded.

7. Prohibited use

It is prohibited to:

• Use the service for unlawful purposes
• Distribute spam or phishing via forms
• Intentionally overload or manipulate the system
• Circumvent security mechanisms

8. Liability

We are only liable for damages caused by intent or gross negligence. Liability for indirect damages and lost profits is excluded, as far as legally permitted.

9. Account deletion

You can delete your account at any time. All data will be irreversibly removed. In the event of a breach of these terms, we reserve the right to suspend accounts.

10. Changes

We may amend these terms. For material changes, we will notify you by email. Continued use after the effective date constitutes acceptance.

11. Applicable law

German law applies. Place of jurisdiction is the operator's registered office.

12. Right of withdrawal for consumers

If you are a consumer, you have a statutory right of withdrawal of 14 days from conclusion of the contract. No reasons need to be given — an informal e-mail to [email protected] is sufficient.

For digital services, the right of withdrawal expires early once we have begun performing the contract after you have expressly consented to us starting before the end of the withdrawal period and confirmed your knowledge that you thereby lose your right of withdrawal (sec. 356 (5) German Civil Code). We obtain this consent at the time of purchase.

In the event of an effective withdrawal, we will refund all payments received without undue delay, at the latest within 14 days of receipt of the withdrawal notice, using the same means of payment you used for the transaction.
