Employment law intake: complete before the deadline ticks

In unfair dismissal claims, every day of the three-week deadline counts. The online intake form captures dismissal date, receipt, company size and works council in a structured way — dismissal letter uploaded, before you even call back.

21 Tage limitation period under sec. 4 KSchG — every avoidable follow-up eats into it

Three weeks — and the clock starts at receipt

The receipt date is always missing

The caller knows they were dismissed — but when the letter was actually received, by courier or letterbox, only emerges after several follow-ups. Yet exactly that date determines the deadline.

Company size and works council: unknown

Whether dismissal protection applies at all hinges on headcount; works council consultation on its existence. You rarely learn either in the first call — and without them no serious initial assessment is possible.

The dismissal letter arrives too late

"Email me the dismissal letter" — then days pass, the photo is illegible or only page one arrives. Meanwhile the deadline approaches and the liability pressure on the firm grows.

How Questee protects the deadline

  1. 1

    Define the deadline-critical questions once

You build the intake form with everything the initial assessment needs: dismissal date and receipt date, mode of delivery, company size, works council yes/no, length of service, special protection. The link sits on your website and goes to every caller.

  2. 2

Client fills it in, dismissal letter included

One question per screen, on the phone right after the call. The dismissal letter and employment contract are uploaded in the same form — no email loops, no illegible photos in the inbox.

  3. 3

You call back with an initial assessment

You are notified the moment the response arrives. Receipt date, company size and the dismissal letter are there, structured — you note the deadline, assess the prospects and discuss the mandate directly in the callback.

Questions from employment law practice

Does the form calculate the limitation period automatically?
No, deliberately: deadline calculation is core legal work and belongs in your hands and your deadline diary. The form ensures the necessary facts — receipt date, mode of delivery — are available immediately and completely, instead of after days of back-and-forth.
How quickly can a caller complete the form?
A typical employment law intake with 15-20 questions plus upload takes about 10 minutes. Because the form works on a phone and supports save-and-resume, many clients complete it right after the call — the dismissal letter is on the table in front of them anyway.
How is this different from a Google Forms questionnaire?
Google Forms stores responses in Google's cloud under US law — a substantial risk for mandate data covered by professional secrecy, and there is no standard DPA process. Questee hosts in Germany, ships the Art. 28 GDPR DPA, scans file uploads for malware and shows questions conditionally per case.
Is online intake compatible with professional secrecy?
We provide the technical and contractual prerequisites: hosting exclusively in Germany, encrypted transfer, tenant-isolated database, Art. 28 GDPR DPA and optional password protection. The professional-law assessment of your processor chain remains — as with any legal software — yours; we make it as easy as possible.
Can employer-side mandates use this too?
Yes — simply create a second form, e.g. for employers preparing a dismissal or reviewing a warning letter: headcount, works council, warning history, contract documents. Both forms run side by side in the same Questee workspace.
What happens to uploaded documents?
Uploads are scanned for malware on receipt and stored encrypted on German servers, accessible only to your firm. You download them from the response view and transfer them into your file. After taking on the mandate you can delete the form response — data control stays with you.
Won't a form put off employees seeking advice?
In practice no, if you frame it right: "So we can check your deadline immediately, please complete these 10 minutes." A dismissed employee wants speed — and a structured form signals that the firm handles the case seriously and systematically. Key: short form, plain language, mobile-friendly. Exactly what Questee is built for.
